According to The Block, Morgan Stanley analyst Nikolaos Panigirtzoglou stated that the SEC must classify ETH as non-securities before it can approve Ethereum ETF spot in May.

"We believe that for the U.S. SEC to approve Ethereum ETF spot in May, it needs to classify Ethereum as a commodity (similar to Bitcoin) rather than securities." "This is far from certain, and I think the possibility of the SEC classifying Ethereum as a commodity before May will not exceed 50%."
