Update for XRP Army: CFTC Chair Stuns Crypto Community With This Reassurance

Crypto commentator and XRP enthusiast JackTheRippler (@RippleXrpie) shared a post featuring CFTC Chair Michael Selig on digital asset regulation. The statement has drawn attention across the crypto community, particularly among XRP holders now that the CLARITY Act is dead.

Selig’s position is clear. The CFTC is ready to act and does not need Congress to move first.

Selig Puts the CFTC on the Record

Selig opened with a firm commitment. “If CLARITY continues to stall because of Democrat obstruction, the CFTC will utilize its existing authorities to begin establishing a regime for crypto asset markets,” he said. “We owe it to the American people to do so.”

He tied the agency’s mission directly to the White House. Selig stated the CFTC would help President Trump deliver on his promise to establish a crypto asset market structure, vowing to codify a framework “that cannot be undone by the crypto haters.”

To that end, Selig directed CFTC staff to explore rules that would allow crypto exchanges to operate as a type of Designated Contract Market under CFTC oversight, specifically called a Crypto Asset Market. He also directed staff to engage with on-chain finance developers to build legal compliance pathways in the U.S.

The CLARITY Act Falls Short

The CLARITY Act had significant momentum heading into September 15. SEC Chair Paul Atkins confirmed the Senate vote publicly and expressed hope the bill would reach President Trump’s desk. Senate Majority Leader John Thune filed cloture before the August recess to secure floor time for the bill.

The vote failed when the Senate returned. The bill received 49 Yes votes and 50 No votes. This implies that it failed the 60 votes required for cloture.

Senate Democrats who spent months negotiating the legislation ultimately voted against it. Susan Collins, Josh Hawley, and Jerry Moran also broke ranks and voted against the bill. Senator Thom Tillis voted no through a motion to recommit.

Regulators Step Into the Gap

The CLARITY Act’s failure does not stop regulatory movement. Both the SEC and the CFTC have committed to using their existing authorities to establish rules for crypto market structure. The SEC released a major rule proposal on September 1 to update transfer agent regulations to accommodate blockchain technology and tokenized securities.

SEC Chair Atkins has acknowledged that rules built without statutory backing will lack durability. Senator Lummis has warned the next realistic legislative window may not arrive until 2030. For now, the agencies move forward on their own authority, and the CFTC chair has made clear his agency will not wait.
