Corteva to End Pesticides Loyalty Program in Settlement With FTC

01:16 PM EDT, 09/28/2026 (MT Newswires) -- Corteva (CTVA) will dismantle its existing pesticides loyalty program under a settlement agreement reached with the Federal Trade Commission and a coalition of state attorneys general, the commission said Monday. The stipulated order will ban Corteva from conditioning payments or other benefits on a distributor buying a greater-than-50% share of its requirements of a pesticide ingredient from the company, as well as any practice limiting purchases of generic equivalents, for 10 years, according to a statement. The order also requires the company to pay the state plaintiffs $35 million to resolve their monetary claims. The co-plaintiffs include California, Colorado, Illinois, Indiana, Iowa, Minnesota, Nebraska, Oregon, Tennessee, Texas, Washington and Wisconsin. The settlement resolves a lawsuit brought by the FTC and states in 2022 that alleged Corteva implemented a post-patent loyalty program that paid distributors to block competitors from selling cheaper generic products to farmers. A Corteva spokesperson told MT Newswires that the company was pleased to resolve the FTC matter and would continue focusing on its business, customers and efforts to deliver innovation and agronomic support to retailers and farmers.
